1. Who We Are

UNSAID is a global peer-support community founded by Pawel Pawlak.

UNSAID services are provided by Pawel Pawlak, operating as Magnis Centrum Pawel Pawlak (NIP: PL7272573636, REGON: 100080102), Obywatelska 102/104/308, 94-104 Lodz, Poland. Data protection matters are covered by our Privacy Policy.

These Terms of Service (“Terms”) govern your use of the UNSAID website, email communications, Witness Sessions, Circles of Truth, the Mirror, the Wall of Unsaid Words, and all related services.

2. Acceptance of Terms

By using unsaid.community, downloading our free materials, subscribing to our emails, booking a Witness Session, or participating in any UNSAID activity, you agree to these Terms. If you disagree with any part, please discontinue use of our services.

We may update these Terms from time to time. Significant changes will be communicated via email to active subscribers and posted on this page. Continued use of UNSAID services after changes are posted constitutes acceptance of the updated Terms.

3. Nature of Services

UNSAID provides peer-support. Peer-support is a form of mutual help between people, based on shared experience or training, that operates outside the system of regulated mental health professions.

3.3 Your responsibility for professional care

You are responsible for seeking professional help if you need it. Participation in UNSAID services is never a replacement for professional psychological, psychiatric, or medical care. If you are currently receiving professional treatment, we encourage you to continue alongside your participation in UNSAID.

4. Eligibility

UNSAID services are intended for adults. You must be at least 18 years of age to use our services.

By using UNSAID services, you confirm that you are 18 or older. If we become aware that someone under 18 is using our services, we will terminate their access and delete their data promptly.

5. Email Subscription

5.1 What you receive

By subscribing to the letters, you will receive:

Every email includes an unsubscribe link. Clicking it removes you from the list that email came from, and it leaves the other list untouched. You can also contact us directly at hello@unsaid.community to request removal from one list or from both. Unsubscription is processed within 48 hours.

6. Bookings, Payments, and Cancellations

6.1 Two session types

UNSAID currently offers two types of Witness Sessions:

Session A: 30 minutes (pay-what-you-can)

Session B: 45 minutes (fixed price)

6.2 Payment processing

All payments are processed by Stripe (stripe.com). UNSAID never stores your payment card details. By making a payment, you agree to Stripe’s terms of service and privacy policy.

Prices are displayed in USD. Currency conversion, if applicable, is handled by your bank or card issuer. UNSAID is never responsible for exchange rate differences or fees charged by your financial institution.

6.3 What you are paying for

You are paying for a scheduled block of time with a trained listener providing peer-support. You are never paying for therapy, clinical advice, a diagnosis, a treatment plan, or any guaranteed outcome.

EU/UK users: waiver of right of withdrawal. Under EU Directive 2011/83/EU and equivalent UK regulations, you may have a 14-day right to withdraw from a purchase of services. By booking a Witness Session scheduled to take place before the expiry of this 14-day period, you explicitly request that UNSAID begin providing the service immediately. You acknowledge that you lose your right of withdrawal after the session has been fully performed.

UNSAID provides a contact form for individuals who are unable to afford any payment for a session. Access through this channel is provided at the discretion of UNSAID and is subject to availability. UNSAID reserves the right to limit the number of free sessions offered per month.

7. Confidentiality

7.1 Our commitment

All conversations within UNSAID services (Witness Sessions, Circles, Mirror correspondence, and any future formats) are confidential. Your Witness will never share the content of your session with anyone outside the UNSAID supervision system. The same commitment binds Circle facilitators and Mirror Writers.

7.2 Three exceptions to confidentiality

Confidentiality has three hard limits:

These exceptions are communicated to you before your first session (in the session description on Calendly and verbally by your Witness at the start of the session), before your first Circle (in the booking confirmation and in the rules read aloud at the opening), and, for the Mirror, in these Terms and on the Mirror page.

7.3 Limitations of crisis intervention under pseudonymity

UNSAID encourages the use of pseudonyms to protect your psychological safety and privacy (see Privacy Policy, Section 3.1). By exercising your right to use a pseudonym and by choosing to withhold your legal name, physical location, or contact details, you acknowledge and accept that UNSAID’s ability to intervene in a crisis (including contacting emergency services on your behalf) is technically and objectively limited or impossible.

A Witness who knows you only by a pseudonym and connects with you through a video call has no means of dispatching emergency services to your location. The same limitation applies to the Circle and to the Mirror: where we know you only by a pseudonym and an email address, our ability to summon physical help on your behalf is objectively limited or impossible.

UNSAID will always attempt to provide crisis resources (hotline numbers, text lines, online services) during a session if a safety concern arises. UNSAID shall never be held liable for an inability to provide physical emergency assistance to a participant who has chosen to withhold identifying information.

If you believe you may be at risk of a crisis, we strongly encourage you to share your first name and general location with your Witness at the start of your session. This information will be used solely for safety purposes and handled in accordance with our Privacy Policy.

7.4 Supervision

Witnesses participate in a supervision system to maintain quality and safety. During supervision, session content may be discussed in anonymized form (no identifying details) to support the Witness’s professional development and ensure adherence to The Witness Method protocol.

7.5 Confidentiality in a group setting (Circles)

In a Circle, confidentiality is a shared commitment: every participant confirms at booking, and hears again at the opening, that what is said in the Circle stays in the Circle. UNSAID enforces this commitment through the rules, the facilitator, and, where needed, removal from the community. At the same time, UNSAID has no technical means of preventing a participant from breaking their own commitment, and accepts no liability for a breach committed by another participant. Protective choices remain yours at all times: a pseudonym, a switched-off camera, and silence each count as full participation.

8. Intellectual Property

8.1 UNSAID content

All text, images, and materials on unsaid.community, in our emails, and in our educational products are the intellectual property of Pawel Pawlak and/or UNSAID and are protected by copyright. UNSAID™, The Witness Method™, the WIN Philosophy™, and Catalog of Victories™ are trademarks of Pawel Pawlak and/or UNSAID. You may share our publicly available content for personal, non-commercial purposes with attribution. You may never reproduce, modify, or distribute our materials for commercial purposes; use our names, logos, or branding; or present our work as your own, in each case without our written permission or a license from UNSAID.

Free downloadable materials. These files are an exception to the sharing permission above. You may download our free materials, print them, and use them for yourself. Sharing the file, hosting it elsewhere, or selling it requires our written permission.

8.2 Your content

Any content you voluntarily share with UNSAID (such as messages in the contact form, testimonials, or feedback) remains yours. By sharing it, you grant UNSAID a non-exclusive, royalty-free right to use anonymized versions of your feedback for promotional or educational purposes. We will never use your name, identifying details, or session content without your explicit written consent.

9.1 No guaranteed outcomes

UNSAID provides a space for peer-support. We never guarantee any specific result, improvement, change in mental state, or resolution of any personal issue. Individual experiences vary. Peer-support is a complement to professional care, never a replacement.

9.2 No medical or legal advice

Nothing on unsaid.community or in our communications constitutes medical, psychological, psychiatric, legal, or financial advice. Any decisions you make based on your participation in UNSAID services are your own responsibility.

9.3 Third-party platforms

UNSAID services rely on third-party platforms: video calls (Google Meet or Zoom), scheduling (Calendly), payments (Stripe), the Wall form (Tally), the Wall’s witness counter (Cloudflare), email delivery (Sender), and website hosting. UNSAID is never responsible for technical issues, outages, data breaches, or service interruptions caused by these platforms. By using a given service, you agree to the terms of the platform involved.

9.4 “As is” provision

UNSAID services are provided “as is” and “as available.” To the maximum extent permitted by applicable law, UNSAID disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

For EU/UK users: Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that applicable law prohibits excluding or limiting.

11. User Conduct

By using UNSAID services, you agree to refrain from:

Violation of these rules may result in immediate termination of your access to UNSAID services, without refund.

11.1 Content moderation

UNSAID reserves the sole and absolute right to moderate, edit, or immediately remove without prior notice any user-generated content (including letters submitted through the Mirror, sentences submitted to the Wall, community forums, and any future interactive format) that UNSAID, at its sole discretion, determines to be harmful, dangerous, abusive, or inconsistent with the principles of the WIN Philosophy and The Witness Method.

This right exists to protect the psychological safety of all community members. Content that may trigger distress in other participants (such as graphic descriptions of self-harm or violence) may be removed or redirected to a private, supervised channel where it can be addressed safely.

12. Termination

12.1 By you

You may stop using UNSAID services at any time. To unsubscribe from emails, use the unsubscribe link in any email. To request deletion of your data, contact us at hello@unsaid.community. Data deletion is handled according to our Privacy Policy.

We reserve the right to suspend or terminate your access to UNSAID services if:

If we terminate your access to a paid service, we will provide a pro-rata refund for any unused, pre-paid sessions or undelivered Mirror responses. Terminations under Section 11 (conduct violations) follow the refund rules stated there and in Section 6.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the courts of Lodz, Poland. For EU consumers: you retain the right to bring proceedings in the courts of your country of residence, as required by EU consumer protection law (Regulation (EU) No 1215/2012).

For all users: Before initiating formal proceedings, you agree to contact UNSAID at hello@unsaid.community and attempt to resolve the dispute informally within 30 days.

14. Severability

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy (available at unsaid.community/privacy), constitute the entire agreement between you and UNSAID regarding your use of our services.
